Texting Drastically Raises Risk of Auto Accident

A new study conducted by the Virginia Tech Transportation Institute has found that texting while driving increases your risk of an auto accident exponentially compared with other driving distractions. This study, which is the first to evaluate the dangers of texting behind the wheel, points out the importance of refraining from engaging in this dangerous behavior while driving.

The study examined the texting behavior of truck drivers over an 18 month period. Cameras were inserted into the cabs of semi-trucks to evaluate both their use of texting and the way it affected their attention to the road.

The study found that drivers had a 23 times greater risk of getting into a truck accident while texting. Furthermore, drivers spent approximately five seconds looking at their cell phones on average while texting. This is enough time to drive more than the length of a football field at high speeds.

Researchers also found that the texting behavior of truckers closely mirrors that of automobile drivers. While trucks are far less maneuverable than cars and take longer to stop, the Virginia Tech study estimates that the risk to car drivers would be roughly similar to what they found among truck drivers. Furthermore, they found that the increased risk of accident caused by texting far surpasses the risk caused by other distractions.

Currently, only 14 states ban texting while driving. Hopefully, this study will convince other states to follow suit. The safety of our nation's drivers is at stake.

Family Files Wrongful Death Suit against Illinois Theater

An Aledo, Illinois family has filed a wrongful death lawsuit against the owners of Great Escape Theatres for the 2007 death of a 50-year-old woman. The spouse and children of the deceased are suing Great Escape Theatres, Alliance Entertainment, and Ragains Enterprises, as well as the architect firm that designed the theater.

In July 2007, the victim slipped and fell at the movie theater breaking several bones. She died a few days later after developing a blood clot which traveled to her lungs. The suit alleges the injuries suffered in the fall caused the clot which killed her.

The lawsuit states the design of the theater's entrance, which includes ceramic tiles next to each studio in the theater, is defective. The tiles are not slip-resistant, and the suit claims this, as well as failure to clean up spills. The ceramic design is used in these theaters to keep spills off the theater carpet and make clean up easier.

The husband and grown children of the victim are seeking more than $50,000 in damages.

It may go without saying that no amount of money can compensate for the death of a loved one, but in many cases the compensation may protect the survivors' future. Blue Food Dye to Help Spinal Injuries?

When a person with a spinal cord injury is admitted to a hospital emergency room, there is no standard treatment. Certainly they are given care and testing in efforts to reduce pain and precisely locate the injury site. When motor nerves in the spinal cord are damaged, they are unable to carry messages to the body's muscles telling them to contract or relax. This causes paralysis in all areas below the injury site. Some patients are given steroids to possibly reduce paralysis, but most are not.

A research team at the University of Rochester Medical Center recently published results of a study they did on mice with spinal cord injuries. They were following up on their research of 2004 where they had studied a substance called ATP (Adenosine Triphosphate) which shows up quickly at the location of any spinal cord injury. It kills off healthy tissue, making the original injury more severe.

They found in 2004 that if they injected an oxidized ATP into the injured rats of their study, it blocked the destructive effect of ATP and the rats recovered their ability to walk. But this was not very useful for application to humans, as nobody would want to insert a needle into an injured spinal cord. That could possibly make the injury worse. Also, injecting ATP into the bloodstream can have serious side effects.

The researchers found in 2004 that the spinal cord contains an abundance of a molecule called P2X7, also called "the death receptor" because it allows ATP to destroy motor nerves. But they also knew that a compound called BBG (Brilliant Blue G) could cancel out the effects of P2X7.

Following Up With Gatorade Blue Color
Since BBG is very similar to a blue food dye approved by the FDA back in 1982 and used in Gatorade and M&Ms, the researchers felt encouraged to test its usefulness for spinal cord injuries.

The team's recent study tested BBG in mice with injured spinal cords and found that those injected with BBG recovered their ability to walk and those not injected remained paralyzed. The BBG did not entirely cure the injury, as the injected mice walked with a limp. But it did reduce the severity.

"Even a moderate improvement in functional performance of the patient is a big, big event for these patients," said Maiken Nedergaard, professor of Neurosurgery and director of the Center for Translational Neuromedicine at the University of Rochester Medical Center. "They can control their bladder. If they can just take small steps instead of sitting in a wheelchair all the time, it's a tremendous benefit for these patients."

Time and future research will determine whether BBG might be effective for humans. It will need to be injected within eight hours of the injury and if that is done, it may greatly reduce the impairment caused by a person’s spinal cord injury.

Fatal New York Car Accident Caused by Dangerous Roadway?

On Sunday, a woman driving a minivan with two of her children and three nieces got on the Taconic State Parkway traveling the wrong direction. She hit another car head-on, then went sideways into a third vehicle before rolling down an embankment and bursting into flames. But this car accident was not an isolated incident. It was the second crash that day involving a vehicle traveling the wrong direction on the Taconic State Parkway. The Taconic State Parkway was begun in 1927 as the "Bronx Parkway Extension," after the route was approved by the New York State Legislature in 1923. Car Accident Leaves American Idol Contestant Dead

In the usually quiet town of Seaside Heights, New Jersey, a woman's body was found on a street, the apparent victim of a pedestrian versus car accident. Man Finds Condom in his Soup, Sues Restaurant

Zdenek Philip Hodousek, a 50-year-old resident of Mission Viejo, California, has sued a local Claim Jumper restaurant after he found a condom in his French onion soup. Hodousek was chewing on what he believed to be a tough piece of cheese. When he could not break it down in his mouth, he spit it out, only to find out that it was a condom.

Hodousek vomited both in the Claim Jumper bathroom and parking lot after the incident. He has had difficulty sleeping ever since and has experienced bouts of severe anxiety, wondering if he has contracted a dangerous disease from chewing the used condom.

Female DNA was found in the condom. Hodousek has requested that all female Claim Jumper employees submit to a DNA test to determine if any of them are a match for the DNA found in the condom. However, Claim Jumper has not been very compliant with this request.

Hodousek's premises liability lawsuit charges Claim Jumper with negligence in allowing a condom to enter their soup. It is uncertain how many other customers ate French onion soup from the same container that evening. Most likely, these individuals had no knowledge that they had consumed soup containing a used condom.

The Claim Jumper chain denies all wrongdoing. They claim that while Hodousek found a "foreign object" in his soup, there is no evidence to prove that this "object" was the same used condom that he brought to a lab for testing.

Jury Awards New York Woman $48 Million in Medical Malpractice Suit

Westchester County, New York saw the largest medical malpractice award in its history when a jury awarded a 30-year-old woman $48 million in her medical malpractice suit against a Mount Vernon internist. There were originally four others named as defendants in the case, but reached settlements before the end of the trial.

Beginning in February 2000, the victim had complained of severe pain in both her legs to Mount Vernon Hospital doctors. The defendants failed to diagnose the problem as a spinal tumor called an astrocytoma. When the tumor was finally diagnosed correctly, the victim suffered permanent damage. She must now get around in a wheelchair most of the time.

The jury found she was owed for pain and suffering, medical expenses and rehabilitation. They found the internist 30 percent liable (he must pay at least $14.4 million), the hospital 25 percent liable, an OB-GYN 15 percent liable, an association the OB-GYN belongs to ten percent liable, and another internist ten percent liable. A doctor who was not named as a defendant in the suit was also found to be ten percent responsible, but the ruling does not carry any legal liability.

The victim is obviously relieved in the ruling. She has been working with a therapist so that she can sometimes get around on crutches, and is able to drive with adaptive technology. However, this happened to the victim when she was 20-years-old. While she is finally able to claim victory, she will be living with this for the rest of her life.

259-Car Pile-up in Germany

On July 19, in northern Germany, a giant pile-up occurred near Hanover. It was late in the day, with the sun hovering low on the horizon and shining in drivers' eyes. It was also raining and slick on the roadway, with puddles where some vehicles skidded and aquaplaned. Despite these conditions, cars were traveling at high speeds.

Scores of ambulances, police cars, and fire engines arrived at the scene, as well as a helicopter, and a tent was set up at the roadside to care for injured people. Sixty-six were injured, of whom ten are reported to be fighting for their lives in local hospitals.

Cars littered the road for a long distance, some off the shoulder, some alone at odd angles, and many in muddled clumps where rear-end collisions had occurred as well as side-swipe collisions.

Emergency workers worked all night treating the injured and police spent the whole night clearing the road of damaged and inoperative vehicles, and debris. This stretch of Germany's Autobahn connects Berlin and Hanover and was in an area with fields on each side.

Police are attributing this massive automobile accident to a combination of weather conditions and fast speeds.

Freeway travel can become monotonous and even hypnotizing, as you sit for long periods going at a uniform speed with no cross-traffic or pedestrians. NHTSA Research on Cell Phones and Car Accidents Stopped, Shelved

According to some research, cell phone use while driving is as dangerous as drunk driving. To confirm this risk and develop guidelines for effective practices that would prevent car accidents and save lives, researchers at the National Highway Traffic Safety Administration (NHTSA) proposed an ambitious long-term study of cell phone use while driving and its risks. However, the NHTSA decided not to pursue the research and was urged to stick to its mission of gathering safety data, rather than developing data and recommending guidelines for state laws that could save lives.

No one knows just how many accidents and wrongful deaths have been caused by cell phone distraction, but estimates say nearly 1000 deaths and 240,000 accidents may have been caused by cell phone distraction since 2002. Cell phone use in cars has grown, and with it, the risk of cell-phone-related car accidents. Research shows that drivers using a cell phone are four times more likely to crash than other drivers, comparable to someone with a blood alcohol content level of 0.08. A blood alcohol content level of 0.08 is considered illegal in all 50 states.

To reduce the risk of cell phone distraction causing accidents, many states have enacted laws requiring hands-free devices, but research does not show that hands-free devices offer significant safety benefits.

Medical Error Leaves Airman Without Legs

After a surgeon botched a routine gallbladder removal surgery, a Texas Airman stationed in California had to have both legs amputated due to a massive amount of blood loss. Twenty-year-old Colton Read underwent routine laparoscopic surgery at a hospital near Sacramento, but about an hour into the minimally invasive procedure to remove his gallbladder, something went terribly wrong. A nurse was heard by the man’s wife saying, "We need blood now," as she was running out of the operating room.

Allegedly, an Air Force general surgeon mistakenly cut Mr. Read’s aortic valve (the valve that supplies blood to the heart) but waited hours to transport the patient to a hospital with a vascular surgeon. Due to blood loss, Mr. Read lost both legs. While the doctor admitted his mistake, the Reads cannot sue under federal law. Because of the Feres Doctrine, the military cannot be sued for its medical mistake. A bill is pending that would end this law

At the time of this writing, Read is still in intensive care, and his gallbladder now cannot be removed due to risk of infection.

Bus Accident Injures 12 at Disney World

Twelve tourists were injured in a bus accident at Disney World in Orlando, Florida. One bus rear-ended the other, causing the collision. There were approximately 50 passengers in total on both buses, which were owned and operated by Disney for the purpose of transporting visitors around the theme park.

All of the injured passengers were taken to local hospitals for treatment. Only minor injuries were suffered in the accident. The timing of this accident couldn't be worse for Disney. It comes less than two weeks after one of their monorail pilots died in a collision with another train.

Thousands of tourists use Disney's park transit system each day in order to get around the sprawling resort. Tanker Truck Explosion in Detroit Injures Three

A tanker truck carrying 13,000 pounds of fuel exploded Wednesday, July 15, as it passed beneath a highway overpass. The driver of the tanker, a semi trailer, and another vehicle were all taken to the hospital to be treated for minor injuries.

Police are still investigating the cause of the accident and are interviewing the injured men. The truck accident occurred around 8:00 pm about ten miles north of downtown Detroit. The tanker truck exploded beneath the 9 Mile Road overpass. Flames and smoke were reportedly shooting and billowing hundreds of feet in the air.

The Environmental Protection Agency has been monitoring air quality and looking into whether any fuel spilled into nearby sewage drains. However, nearby residents were not evacuated and there are no warnings in place.

It is incredible that the three drivers were not more seriously injured or killed. Equally incredible is that surrounding vehicles were not caught up in the accident as the fuel exploded. Accidents involving tanker trucks have the ability to involve many more people than another type of truck accident. Refunds for Asbestos-Tainted Toys

In 2008, after watching a television show called CSI: Crime Scene Investigation, many parents bought toy fingerprint kits and forensic lab kits. They were manufactured by Planet Toys, Inc. and sold for $30 each.

They were found to contain asbestos, a mineral that is strongly linked to mesothelioma (a form of cancer) and also causes asbestosis, a potentially fatal lung disease. Asbestos is a fibrous substance and its microscopically tiny fibers easily become airborne and can be breathed in. They become lodged in lung tissue, or sometimes in heart or abdominal tissue, and the body is unable to remove them.

Class Action Suit

In May of 2008, a class action suit was filed against Planet Toys by parents who had bought the toys expecting them to be educational. Both kits had a powder containing asbestos and children could well have been exposed to the asbestos fibers that became airborne, or that they may have accidentally ingested from their fingers.

The Wall St. Journal recently reported that refunds are now being offered to customers who bought these toys. However, Planet Toys filed for Chapter 7 bankruptcy protection in March, 2009, after negotiating for a settlement to the class action lawsuit. So it is not this company that will pay for the refunds, but the retailers who sold the toys.

Specifically, those retailers are:

  • Toys R Us
  • CBS Broadcasting, Inc. and
  • K-Mart

Medtronic Issues Voluntary Recall of 3 Million Insulin Pump Infusion Kits

Last week, Medtronic issued a recall of about 3 million infusion sets designed for use with the company's MiniMed Paradigm insulin pumps. The recall was issued because about two percent of the sets (about 60,000) may have been affected by a manufacturing defect and may not work properly. When the infusion sets work improperly, it may result in the pump delivering too little or too much insulin. For people who depend on these pumps, the result may be serious injury or death.

The infusion set is the thin plastic tube that delivers insulin from the pump to the diabetes patient. They are replaced frequently by the patient.

To find out whether your Quick-Set infusion sets are affected by this recall, look for the reference number and lot number on the label of the package or the individual infusion set packaging. The reference number is in the middle left of the label next to the letters "REF." Four different reference numbers are affected by the recall: MMT-396, MMT-397, MMT-398, and MMT-399. The lot number is located directly under the reference number, nexted to the boxed word "LOT." It is a seven-digit number. All affected infusion kits have lot numbers beginning with the number 8 (8XXXXXX).

If a person with diabetes gets too little insulin, they may develop hyperglycemia, which can lead to ketoacidosis and a diabetic coma. Regular insulin users may detect hyperglycemia with a regular blood glucose level test. You should also look out for these symptoms of ketoacidosis:

  • Elevated thirst

  • Frequent urination

  • Tiredness

  • Dry or flushed skin

  • Nausea or vomiting

  • A fruity odor on the breath

  • Confusion or shortened attention span

On the other hand, if a person gets too much insulin, they can suffer from hypoglycemia, with these symptoms:

  • Shakiness or dizziness

  • Sweating

  • Pale skin

  • Clumsy movements or seizures

  • Sudden, excessive hunger

  • Behavioral or mood changes

A person can also pass out from hypoglycemia. Both conditions can be emergencies and should be treated when suspected.
