Causes of Construction Accidents

It's rarely the case that an accident at a construction site was truly unavoidable. While the true cause of an accident might rest miles from the work site, it's the experience of our construction accident lawyers that negligence is often the root cause of these incidents.

Employers will often allege that it was the injured worker who was negligent, and construction workers are certainly expected to exercise care and caution while on the site. However, these claims are often attempts to obfuscate the reality: the work site was dangerous.

Common causes of construction accidents include:
  • Defective equipment
  • Shoddy wiring, leading to electrical shocks
  • Poorly stored chemicals or other dangerous materials
  • Preventable fires
  • Falling rocks or building materials
To be sure, fault is often not a significant issue in construction accidents. Most states handle construction accidents through the workers' compensation system, and many of these systems are no-fault, meaning you can receive compensation even if you played a role in the accident.

However, a personal injury suit is still possible in some circumstances. In these cases, fault is obviously tremendously important. The Cochran Firm's construction accident lawyers will launch a thorough investigation to determine and prove liability.

If you've been hurt in a construction accident, you should speak to our lawyers and see about getting help with workers' compensation or a personal injury suit. Please contact The Cochran Firm today for a free consultation.

Can You Handle an Aviation Accident Case?

Aviation accidents are, needless to say, exceptionally complex. While commercial air travel is, statistically, very safe, small planes present unique challenges to those operating them. When there are design or manufacturing defects in these planes, the challenges become even more complex.

The Cochran Firm's injury lawyers have experience with aviation accidents. We're capable of handling cases dealing with defective or poorly manufactured airplanes and airplane parts.

Because these cases are so complex, and involve difficult investigations to determine if pilot error or manufacturer negligence was responsible, it's important to find an injury lawyer with experience. The Cochran Firm offers just such experience.

Each state has different laws governing aviation liability and manufacturing standards. Our injury lawyers will be aware of the appropriate laws in your state. This enables us to advise you as to the viability of a potential legal claim.

Airplane crashes are almost always deadly, and when they're not they result in serious, even catastrophic injuries. The Cochran Firm's injury lawyers are equipped to help you pursue justice and compensation if you were hurt in one of these crashes.

If you've suffered in an injury as a result of an airplane crash and you want to speak to an injury lawyer with appropriate experience, please contact The Cochran Firm today for a free consultation.

Abuse of Restraints in Nursing Homes

Nursing home abuse can take many forms. One of the most common that The Cochran Firm's personal injury lawyers see is abuse of medical restraints. When improperly used, these restraints are not just demeaning and humiliating; they can also hurt nursing home residents.

Medical restraints have valid uses. Some nursing home patients are uncooperative or physically incapable of remaining still during medical procedures. In these cases, restraints can prove helpful, but only if used sparingly and correctly by trained staffers.

Too often, however, restraints are used as tools of punishment by staff members. Our personal injury lawyers understand that restraints are not to be used simply because a resident questions some element of his or her treatment or raises concerns.

The other concern is the mis-use of restraints. Even when a situation calls for the deployment of these tools, restraints must be used properly. When they aren't, perhaps because staff members are improperly trained, restraints can cut off circulation and cause significant pain and discomfort.

The Cochran Firm's personal injury lawyers stand ready to help all those hurt by negligent or abusive nursing home staff members.

If your loved one has suffered an injury as a result of nursing home abuse or neglect, you should speak with our personal injury lawyers. Please contact The Cochran Firm today for a free consultation.

The General Motors Recall

By now you've probably heard quite a bit about General Motors and its recall of more than 2.5 million vehicles for ignition switch malfunctions that can cause the vehicles to suddenly stop in the middle of a drive. GM's CEO testified before Congress at contentious, televised hearings, and the comedy program Saturday Night Live skewered her performance at those hearings.

At The Cochran Firm, our defective product attorneys are primarily concerned with the human costs of GM's errors. GM has connected at least 13 deaths to the ignition switch malfunctions, which can disable the vehicle's airbags in a crash. And the number of innocent victims killed by this malfunction might be even higher.

Further, investigators are continuing to look into the question of what GM knew and when they knew it. Sadly, history has made clear that large companies rarely move with impressive speed upon hearing of defective products.

If you have one of the affected vehicles (a Chevy Cobalt or HHR, a Pontiac G5 or Solstice or a Saturn Ion or Sky), you should remove everything from your keyring save your key. Then, contact the nearest GM dealer about a replacement part, which they will install for free once they receive the proper parts.
Our defective product attorneys will monitor the situation and evaluate questions of liability arising from this tragic situation. For more information, you can visit GM's ignition recall site.

If you've been hurt by a defective or poorly designed product, our defective product attorneys will listen to your story. Please contact The Cochran Firm today for a free consultation.
