Swimming Pool Accident Lawsuits

Swimming pools are a delightful feature of a home or a resort. They can help a person enjoy the hot summer months, but they can also be dangerous. Both drowning and near-drowning accidents can be tragic. Whether the result is a wrongful death from drowning, anoxic brain injury from near-drowning, or a spinal injury from a diving accident, many swimming pool accidents could have been prevented.

Defective pools are responsible for many accidents. A pool with inaccurate or absent depth markers can increase the risk of diving accidents. Dangerous suction from drains can draw swimmers to the bottom of the pool, leading to drowning. Some drains are powerful enough to pull organs out of the body. A defective pool may be the basis for a product liability lawsuit.

Poorly maintained pools can lead to accidents. Uneven surfaces around the pool often occur as the pool settles, and these can be falling hazards which can lead to head injuries and drowning accidents. Poorly maintained ladders or rescue equipment can make it harder for distressed swimmers to get out of a pool or for people nearby to render assistance.

A public pool should have adequately trained and supervised lifeguards. Sometimes drowning and near-drowning occurs when a lifeguard is unable to pull a distressed swimmer from the water or provide CPR. In addition, pools that rely on teenagers to serve as lifeguards must know that these young people are susceptible to distraction, and that it only takes a short period of distraction for a deadly swimming pool accident to occur. Failure to instill lifeguards with an appropriate sense of the gravity of their position can contribute to dangerous swimming pool accidents.

If a loved one suffered spine injury, brain injury, or death as a result of a swimming pool accident, you may be entitled to compensation. Get a free case review from The Cochran Firm to learn more about your rights.
