How Can Personal Injury Law Help Me After My Injury?

When you’ve suffered an injury as a result of someone else’s negligence or misconduct and the case doesn’t fall under a criminal statute, your best recourse is often through personal injury law. Having the personal injury lawyers at The Cochran Firm on your side will help tremendously as you pursue justice and compensation.

The law recognizes that there are situations where criminal prosecution is inappropriate, but an innocent victim is still deserving of compensation for their injuries. No one would argue that a property owner should be thrown in jail as punishment for a slip and fall case, for example, but it’s fair to hold that person accountable for his mistakes.

Personal injury law is society’s way of establishing that accountability. While the harm suffered by a victim is usually physical, personal injury lawyers are capable of pursuing compensation for psychological and emotional harm as well.

Personal injury law is a broad term that can encompass:
Put simply, if you’ve suffered an injury as a result of someone else’s mistakes, you should speak to our personal injury lawyers. We’ll be able to determine if you have a viable claim and advise you on whether legal action is right for you.

Why Would I Get a Stiffer Sentence?

At The Cochran Firm, our criminal defense attorneys understand that we need to treat every case with the importance it deserves. There are no shortcuts in the law, and your criminal case is too crucial to be dealt with in a one-size-fits-all manner.

Sentencing statutes vary from state-to-state and municipality-to-municipality. Our criminal defense attorneys will be familiar with how your local court system decides on the length of sentences.

However, there are some broad sentencing guidelines that most courts share in criminal cases. As a general rule, you might be subjected to a longer sentence if:
  • You were on probation at the time of the alleged crime
  • You have a past criminal history, especially with similar charges
  • You were in possession of, or used a, weapon during the crime
  • The crime took place near a school
There are other, far less reputable and thoroughly unofficial factors that tend to produce harsher sentences. Sadly, racial minorities tend to face stiffer sentences than white defendants charged with the same crimes, and media attention can pressure judges and prosecuting attorneys to push for harsh sentences.

The Cochran Firm’s criminal defense attorneys are committed to providing you with a spirited defense, as you are entitled to under the Constitution. We’ll be your advocate at every step of the process.

How Will You Determine Liability for my Accident?

One of the most underrated qualities of a good accident lawyer is investigative skill. When choosing your accident lawyer, you want an attorney with a proven track record of investigating complex accidents like yours.

At The Cochran Firm, we offer just such experience. We will thoroughly investigate your accident to determine its cause, then pursue compensation from the parties responsible.

How? Each investigation is different, but we work by:
  • Interviewing witnesses
  • Poring over police and medical reports
  • Examining physical evidence
  • Chronicling tread marks and other signs on the road
  • Looking at any relevant surveillance footage
  • Examining GPS data (especially in the case of truck accidents)
Once we understand the circumstances of your accident, we’ll be able to apply all the relevant local laws. Personal injury law is all about the concept of “breach of duty,” and with our investigative experience we’ll be able to establish that such a breach exists.

What are “Standards of Care?”

It’s always tragic when someone is hurt or killed while under the care of medical professionals. However, the medical malpractice lawyers at The Cochran Firm understand that not every tragedy qualifies as a legal claim. In order to have a viable claim for medical malpractice, you must be able to demonstrate that the medical professional treating you violated the accepted standards of care.

“Standards of care” is a legal term in personal injury law which refers to the degree of prudence or caution a person is reasonably expected to display for another person. In the case of medical malpractice, it is usually interpreted to mean how a reasonable, qualified medical professional would have handled a given situation.

This is obviously a rather broad concept, and proving that a medical professional violated the accepted standards of care in your particular case requires an experienced medical malpractice lawyers.

Standards of care in a medical setting can include:
  • The procedure used to treat a condition
  • The equipment used during treatment
  • Method of diagnosis
  • Proper investigation into a patient’s medical history
So, for example, if a doctor uses procedure A to treat a condition, you suffered some harm from the procedure and your medical malpractice lawyer can prove that the accepted standard of care for the condition is procedure B, you might have a viable claim.

If you’ve been hurt by the negligence or misconduct of a medical professional and you need an experienced medical malpractice lawyer, please contact The Cochran Firm today for a free consultation.
