What are “Standards of Care?”
It’s always tragic when someone is
hurt or killed while under the care of medical professionals.
However, the medical
malpractice lawyers at The Cochran Firm understand
that not every tragedy qualifies as a legal claim. In order to have a
viable claim for medical malpractice, you must be able to demonstrate
that the medical professional treating you violated the accepted
standards of care.
“Standards of care” is a legal term
in personal
injury law which refers to the degree of prudence or
caution a person is reasonably expected to display for another
person. In the case of medical malpractice, it is usually interpreted
to mean how a reasonable, qualified medical professional would have
handled a given situation.
This is obviously a rather broad
concept, and proving that a medical professional violated the
accepted standards of care in your particular case requires an
experienced medical malpractice lawyers.
Standards of care in a medical setting
can include:
- The procedure used to treat a condition
- The equipment used during treatment
- Method of diagnosis
- Proper investigation into a patient’s medical history
So, for example, if a doctor uses
procedure A to treat a condition, you suffered some harm from the
procedure and your medical malpractice lawyer can prove that the
accepted standard of care for the condition is procedure B, you might
have a viable claim.
If you’ve been hurt by the negligence
or misconduct of a medical professional and you need an experienced
