Can I Tell If I’ve Suffered From Medical Malpractice?

Not necessarily. We work with many medical malpractice victims who were injured after a medical professional was negligent or incompetent when caring for or diagnosing them. Medical malpractice cases require expert medical witnesses to first assess the medical records before the case is taken on, and then to possibly testify in court against a fellow professional.

If you had surgery several months ago and are still not feeling well, that in itself is not an indication of any surgical malpractice. We would need to study your medical records to find evidence that someone was negligent and did not follow the expected standards of care for your condition. Perhaps the nurses have neglected to give you the prescribed medications or the correct dose. You may not know they were prescribed or what the dose should be.

Unless you find something dramatically and obviously wrong, such as a physician having amputated the wrong foot, it is hard for a patient to determine whether medical malpractice has occurred. Without going through medical school a lay person lacks the knowledge to make that decision.
