Chinese Drywall Lawsuits Get Class Action Status
For the thousands of families who continue to suffer with defective Chinese drywall in their homes, justice has been slow in coming, but it is coming. In April, a Federal judge awarded $2.6 million to seven Virginia families for damage to their homes caused by this defective product. Now, over 150 lawsuits in the Miami-Dade area have been granted class action status.
The home and business owners who are involved in the lawsuit are happy with the outcome, and one of their attorneys notes: "if we have to go home by home, justice will be delayed." These lawsuits all originate in the Homestead, Florida area southwest of Miami. The plaintiffs in the lawsuits are all condo, townhome, and single-family homeowners.
The defendants in the lawsuit include a construction company, a real estate company, a holding and investment company, and a supplier, all of whom were involved in building the three subdivisions that are the source of the lawsuits.
Nationwide, over 3000 families have complained about the effects of Chinese drywall on their homes and their health. The drywall has been found to emit hydrogen sulfide, a poisonous, colorless, and highly malodorous gas. Affected homes have been described as unlivable because of the stench. Metal components in the house, including electrical wiring, become corroded quickly, and may need frequent replacement. Some residents have even complained about health effects, such as nosebleeds and general health effects, although these have not been confirmed. Although hydrogen sulfide is highly toxic, toxic exposure is rare because of its strong odor.
