Possible Medical Malpractice Case for the Bengals
Rashad Jeanty, a former linebacker with the Cincinnati Bengals, fractured his left fibula on January 9, 2010, in a playoff game against the New York Jets. The Bengals medical staff informed Jeanty that he did not need surgery for his injury. Jeanty visited the Miami Dolphins as a restricted free agent and was informed that he required major surgery in order to stabilize his leg. The Dolphins were uninterested in Jeanty due to his injury.
Jeanty underwent the surgery for his leg and was thought to be placed on the reserve list for the Bengals. However, due to his injury, the Bengals cut him from the roster even though Jeanty was an extremely valuable player for the team and had won the Ed Block Courage award in 2008.
The Bengals medical staff misdiagnosed Jeanty’s injury and did not get him the medical attention he needed to properly recover from the fracture. The misdiagnoses cost him potential employment in the form a place on the Miami Dolphins roster.
Medical malpractice is the misdiagnoses or mistreatment of an injury or health condition by a medical professional. The Bengals medical staff had a duty and a responsibility to correctly diagnose Jeanty and to get him further medical attention for his injury.
If you live in the Miami, Florida area and believe you have been the victim of medical malpractice, please contact the experienced Miami medical malpractice attorneys at the Cochran Firm today to schedule an evaluation of your case.

Zicam Cold Remedy Defects in Miami, Florida
Zicam Cold Remedy Nasal Gel, Zicam Cold Remedy Nasal Swabs and Zicam Cold Remedy Nasal Swabs for Kids were withdrawn from store shelves by their manufacturer after a warning from the Food and Drug Administration (FDA) said there were reports of consumers losing their sense of smell after using this product.
Although the manufacturer of Zicam, Matrixx Initiatives, Inc. recalled these products from store shelves, they have denied any link between Zicam and anosmia. A researcher has discovered scientific evidence that nasal cold remedies containing zinc may indeed cause a loss of the sense of smell, known as anosmia in the medical community.
It is estimated that over two million Americans suffer from this disorder which can have serious consequences. Anosmia can inhibit an individual’s ability to detect serious threats to their health and well-being such as gas leaks, fires, poisonous fumes or spoiled food products. The loss of the sense of smell can effect a person’s ability to earn a living as well.
If you live in the Miami, Florida area and you or someone you love has lost their sense of smell after using Zicam Cold Remedy products, please contact the defective pharmaceutical attorneys at The Cochran Firm today to schedule a confidential consultation to learn how to proceed to protect your legal rights and get the financial compensation you deserve for the injury you have suffered.

Defective Chinese Drywall in Miami, Florida
Thousands of homes in South Florida and across the United States contain defective Chinese drywall that was imported into this country during a domestic drywall shortage between 2004 and 2007 that was brought about by a combination of a housing boom and hurricane damage in the southeast.

Gulf Coast Oil Spill Effects in Miami, Florida
Oil from the Deepwater Horizon oil rig disaster has entered the Loop current and could be carried into the Florida Keys and up Florida's Atlantic Coast, damaging coral reefs and ruining beaches. The Loop current moves according to shifting winds and other environmental factors and as a result, the oil slick has defied scientists' efforts to accurately track and predict its path. Florida's 1,260 miles of coastline has yet to be affected even as coastal communities make containment and cleanup preparations.
British Petroleum, which leased the oil rig, is the responsible party for the spill and will be compelled to pay damages if the oil spill in the Gulf spreads to Florida's beaches and sensitive mangrove forests. South Florida's hotels, restaurants, dive companies and charter fishing companies' employees and owners stand to lose their livelihoods from the adverse effects of the disastrous oil spill in the Gulf of Mexico.
The experienced environmental and toxic tort attorneys at The Cochran Firm are ready to advise you and guide you through the process of protecting your future quality of life in the event you are affected by the threatening oil spill in the Gulf.
If you live in Miami, Florida or the surrounding area of South Florida and you have questions concerning the oil spill and its' effect on your quality of life, please contact the environmental and toxic tort attorneys at The Cochran Firm today at no cost to you to learn how we can help you at this difficult time.

First Defective Chinese Drywall Jury in Favor of Plaintiffs
• Respiratory problems
• Nose bleeds
• Coughing
• Eye irritation
• Throat irritation
• Sinus problems
Our attorneys are seeking damages including, but not limited to:
• The cost of removing all the defective drywall
• Replacing the dangerous drywall with high quality drywall that is mold resistant
• Removal of any damaged property
• Replacement of damaged property such as heating and air units, electrical wiring, or even the entire reconstruction of your home or place of business
After over a year of defective drywall cases being litigated, settlements are being made. One Florida couple, who had fled their home because of the drywall, was just awarded $2.4 million in damages in the country's first jury trial over the defective drywall. This may just set the tone for the thousands of similar cases in the works at this time. The jury ruled that the couple should receive more than simply the costs to repair the home; they were awarded damages for "loss of enjoyment of life" and because the drywall stigma may reduce their home’s worth should the couple want to sell in the future.
If you had to leave your home and/or were made ill due to defective Chinese drywall, please contact The Cochran Firm's experienced defective product attorneys today to schedule a confidential, no-cost consultation.

Chinese Drywall Lawsuits Get Class Action Status
For the thousands of families who continue to suffer with defective Chinese drywall in their homes, justice has been slow in coming, but it is coming. In April, a Federal judge awarded $2.6 million to seven Virginia families for damage to their homes caused by this defective product. Now, over 150 lawsuits in the Miami-Dade area have been granted class action status.
The home and business owners who are involved in the lawsuit are happy with the outcome, and one of their attorneys notes: "if we have to go home by home, justice will be delayed." These lawsuits all originate in the Homestead, Florida area southwest of Miami. The plaintiffs in the lawsuits are all condo, townhome, and single-family homeowners.
The defendants in the lawsuit include a construction company, a real estate company, a holding and investment company, and a supplier, all of whom were involved in building the three subdivisions that are the source of the lawsuits.
Nationwide, over 3000 families have complained about the effects of Chinese drywall on their homes and their health. The drywall has been found to emit hydrogen sulfide, a poisonous, colorless, and highly malodorous gas. Affected homes have been described as unlivable because of the stench. Metal components in the house, including electrical wiring, become corroded quickly, and may need frequent replacement. Some residents have even complained about health effects, such as nosebleeds and general health effects, although these have not been confirmed. Although hydrogen sulfide is highly toxic, toxic exposure is rare because of its strong odor.
If your home has been affected by Chinese drywall or by other defective building materials, you may be eligible to receive compensation. The product liability lawyers of The Cochran Firm Miami stand ready to help. Please call or email us today for a free case evaluation.

Truck Accidents in Miami, Florida
Truck accidents that involve tractor trailers, semi-trucks, or freight carriers like log trucks, automobile transporters, and gasoline tanker trucks almost always cause catastrophic damage when involved in a crash. When these huge trucks crash, they can spill hazardous substances, cause multi-vehicle involvement and reduce passenger vehicles to scrap heaps.
On any given day there are over three million trucks on the highways nationwide. Many businesses in the United States rely on the trucking industry and their ability to move commodities from coast to coast efficiently and relatively inexpensively. Truck drivers are professionals whose own lives depend on safe driving practices, but sometimes the trucking company does not always put safety first, but puts profit over safety.
Speeding to meet deadlines, driving hours without rest and using drugs to stay alert while behind the wheel contribute to many accidents involving trucks. If you are involved in an accident with a truck, you really have the entire trucking company for an adversary. It is very important that you be represented by an experienced truck accident attorney who is skilled in combating the team of lawyers working for the trucking company against you.
You should be financially compensated for all your medical expenses, loss of present and future income, your pain and suffering and loss of enjoyment of life caused by your involvement in the truck accident.
If you have had an accident involving a truck and feel overwhelmed by the trucking companies efforts to prevent you from getting the financial compensation you deserve, please contact the Miami, Florida office of The Cochran Firm today.

Truck Crash Kills Driver, up to 100 Animals North of Miami
Late Monday night, a driver heading south on US 27 in Broward County lost control of his semi truck carrying sheep, pigs, goats, and chickens. The truck then jackknifed across the highway and stalled. Instead of setting up reflective triangles, the driver either left the scene of the accident or attempted to signal other drivers with a flashlight (reports are contradictory). When another truck came south, it either did not see the truck or the signal or was unable to stop. It struck the truck and trailer in a deadly truck accident unlike anything seen in Broward County, according to the Florida Highway Patrol.
The driver of the second truck and dozens of animals were killed. Dozens more animals were wounded. Truck parts and wounded animals lay strewn across southbound US 27. As emergency crews arrived, the surviving animals cried out in pain and confusion. Those that could still move were running around randomly. Groups of animals headed north and south. Some escaped into the everglades, and could be heard bleating overnight. Emergency crews, animal control, and volunteers helped to gather the animals. Some were placed in a temporary corral until they could be removed to a nearby farm. In addition to those killed immediately, many were badly wounded and had to be euthanized. Overall, as many as 100 animals may have died at the scene. Animal bodies were heaped alongside the road, which remained closed through the morning. Most escaped animals are believed to have been caught, but drivers are still urged to use caution.
This deadly truck accident could have been prevented. There is no information as to why the first truck driver lost control of his truck and entered a jackknife. Why did this driver not protect the area with reflective triangles, trying instead to use a flashlight to warn the oncoming driver? Some reports indicated that the driver was transporting animals to his own farm, and that he may have been a less experienced truck driver. His inexperience may have contributed to the jackknife and his questionable measures to alert the oncoming truck.
If you lost a loved one in a truck accident that could have been prevented, the lawyers of the Miami, Florida office of The Cochran Firm can help. Please contact us today for a free initial consultation.
